Another amendment to the Law on Assistance to Citizens of Ukraine with the signature of the President of the Republic of Poland to be effective with 1st July

President of the Republic of Poland signed into law the Act of 15 May 2024, amending the Law on Assistance to Citizens of Ukraine in Connection with the Armed Conflict on the Territory of Ukraine and certain other laws.

The law aims to amend, supplement or extend the functioning of the legal framework for legal residence in Poland of Ukrainian citizens who had to emigrate from their country due to the armed conflict. The law will enter into force on 1 July 2024 (with exceptions).

Ministry of Family, Labour and Social Policy plans to implement EU minimum wage directive in autumn already. The government's proposal for a minimum wage in 2025.

The head of the Ministry informed of the need to implement the EU minimum wage directive into Polish law by autumn of this year. The details of the draft law are currently under discussion. The EU directive on adequate minimum wages requires member states to assess the adequacy of the minimum wage using one or more so-called indicative reference values – these can be, for example, an appropriate percentage of the national average wage.

At the same time, we would like to remind that the minimum monthly wage increases to PLN 4,300 gross as of 1 July 2024. The government has also proposed that the minimum wage in 2025 should be PLN 4626 gross, and the minimum hourly rate – PLN 30.20 gross

Law on whistleblowers referred to the President

On June 14, 2024, the Parliament adopted Senate amendments to the draft law on whistleblower protection, which provide for the deletion of labour law violations from the catalog of violations reportable by whistleblowers. However, employers under their own internal reporting procedures will be able to expand the catalog of violations to include such cases (which are based on common law or intra-company acts). Thus, there is nothing to prevent employers from enabling labour law notifications.

The law has been referred to the President, who has 21 days to sign it. Once it comes into force, employers with minimum 50 people will have 3 months to implement internal reporting procedures.

Easier visa application for Pole Card holders aged 65+

Holders of the Card of the Pole aged 65 and over can apply for a national visa based on it at all Visa Application Centers without reserving appointments in advance. However, the territorial jurisdiction of the consulates must be taken into account when applying.

Higher consular fees from June 2024

Effective 1 June 2024, the fee for accepting and processing an application for a national visa and accepting and processing an application for reconsideration of an application for a national visa is 135 EUR. On the other hand, the fee for accepting and processing an application for reconsideration of a Schengen visa application – 80 EUR.

As of 11 June 2024, the fee for processing a Schengen visa application is 90 EUR, and 45 EUR for applicants aged 6-12. The change is related to the periodic review of fees, which the European Commission is required to do.

The fee for accepting and processing a Schengen visa application for reconsideration remains unchanged), fees reduced under visa facilitation agreements (except Cape Verde) and fees reduced under national regulations.

IMPORTANT! The fee for processing a Schengen visa application and processing a Schengen visa reconsideration application for Belarusian citizens will not change and will remain at the current level.
