As we have highlighted previously (for details see here), the Polish Minister of Finance recently announced amendments to the new WHT regime, indicating that the draft of the new, less rigorous provisions to apply WHT relief could shortly be revealed and enter into force as soon as 1 January 2021.

As it turns out, however, due to the COVID-19 pandemic, it is likely that the reform will be put on hold. At Crido we are leading a working group on the WHT reform under the auspices of the International Group of Chambers of Commerce (IGCC), and through IGCC we have submitted a formal request to the Ministry for an update of the reform. We were informed that the draft bill has already been prepared. However, due to current legislation schedules, priorities and COVID-19 developments, it is likely that a new (5th!) regulation postponing the new WHT regime’s entry into force will be issued.
