On 15th September, the government published a regulation on the amount of the minimum wage and the amount of the minimum hourly rate in 2024. According to it, from 1st January 2024 the amount of the minimum wage will be PLN 4242 gross, and from 1st July 2024 – 4300 PLN gross, which is 700 PLN more compared to the amount currently in force. As for the hourly rate, on the other hand, from 1st January 2024, the minimum hourly rate for work for certain civil law contracts will increase to PLN 27.70 gross, and from 1st July 2024 to PLN 28.10 gross. The increase in the minimum wage will also result in an increase in other benefits related to the employment relationship, which are calculated on its basis (e.g., demurrage pay).
The 7th April 2023 amendment to the Labour Code repealed the existing telework regulations, while introducing a 6-month transition period for employers to comply with the change. This means that teleworking will no longer be possible after 7th October 2023. The employers should verify that all internal regulations on telecommuting have been rescinded, and that the working conditions of existing telecommuters are aligned with those regulated by the remote work regulations.
The Council of the European Union has agreed to extend temporary protection for those fleeing Russian aggression against Ukraine from March 2024 to 4th March 2025. The scheme provides immediate and collective (i.e., without having to process individual applications) protection for Ukrainian citizens who are unable to return to their country of origin. This means that Ukrainian citizens will be able to enjoy residence facilities for one year longer than previously planned.
In connection with the upcoming parliamentary elections, we would like to remind you that members of a election commission, in connection with the performance of their tasks, are entitled to exemption from work for the day of voting and vote counting, as well as for the day following the day on which the vote counting was completed, while retaining the right to social security benefits and rights under the labor relationship. In addition, they are entitled to 5 days of leave from work with retention of the right to social security benefits and rights from the labour relationship, except for the right to remuneration.
In order to exercise these rights, one must, at least 3 days before the expected date of absence from work, notify the employer in writing of the reason and expected period of absence from work, and then, no later than the day following the expiration of the period of absence from work, provide the employer with a certificate justifying the absence from work with the performance of committee tasks.
European Union member states have until 15th November 2024 to implement the Directive on Adequate Minimum Wages in the European Union. The aim of the directive is to guarantee better living and working conditions by ensuring the adequacy of statutory minimum wages in EU countries, promoting collective bargaining to set wages, and increasing effective access of workers to minimum wage protection rights in cases provided for by national law or collective agreements.
